A shocking case came to light in the Supreme Court on Friday where a husband filed a petition against his wife to file a case of cheating. In this petition, the husband has stated that his wife should be criminally prosecuted because she is a man and her genitals belong to a man. After knowing the seriousness of the matter, the Supreme Court agreed to hear it. When the man presented a medical report which revealed that his wife had an incomplete hymen. Imperfect hymen is a congenital disorder in which an unopened hymen completely obstructs the female genitalia.
Here is the Case
The husband's counsel
representing the person, senior advocate NK Modi told the bench that it is a criminal offense under section 420 (cheating) of the Indian Penal Code as the wife turns out to be a man. The lawyer said that he is a man. This is definitely cheating. Please refer to medical records. It is not a case of any congenital disorder. This is a case where my client has been cheated by marrying a man. She certainly knew that her genitals were male.
She is not a woman, she is a man,
this matter first came to the fore in May 2019. Then a Gwalior judge had taken cognizance of the allegation of cheating against his alleged wife on a complaint by the victim. The victim had alleged that she was married in 2016. But soon after marriage he came to know that his wife is not a woman but a man. He has male genitals. That is, she was not fully eligible for marriage. His family members cheated.
